Terms of Service

1. Acceptance of Terms

Welcome to Discovrd. By accessing or using our website at discovrd.org (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify registered users of material changes via email or platform notice.

2. Description of Service

Discovrd is a curated discovery platform that helps users find high-quality Discord servers and bots. We aggregate publicly available Discord server information, accept user submissions, and present curated listings with community reviews and ratings.

The Service includes:

• Curated directory of Discord servers and bots
• User accounts with Discord OAuth authentication
• User-generated content (reviews, ratings, bookmarks)
• Premium listing placements (paid feature)
• Content discovery and search functionality
• Display advertising and sponsorship opportunities

5. User Accounts

5.1 Account Creation

To access certain features (reviews, bookmarks, premium listings), you must create an account. You can register using email and password, or authenticate via Discord OAuth. If you use Discord OAuth, you grant us access to your Discord username, ID, email, and avatar as described in our Privacy Policy.

5.2 Account Responsibilities

You are responsible for:

• Maintaining the security of your account password and/or Discord account
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your account information is accurate and up-to-date

5.3 Account Termination

You may delete your account at any time through your profile settings. We may suspend or terminate your account if you violate these Terms or our Community Guidelines.

5.4 Account Security and Lockouts

To protect your account from unauthorized access and brute-force attacks, we implement automatic security lockouts:

• Failed login attempts: If 5 or more failed login attempts occur within a 15-minute window, your account will be temporarily locked
• Lockout duration: Account lockouts last for 1 hour from the time of the last failed attempt
• Lockout notification: You'll see a message indicating your account is locked and when it will be unlocked
• Security logging: All login attempts (successful and failed) are logged with timestamp and IP address for security monitoring (see our Privacy Policy Section 8.2)
• Persistent lockouts: If you experience repeated lockouts, this may indicate unauthorized access attempts. Contact us immediately via our contact form

Password reset during lockout: You can request a password reset at any time, even during an active lockout. Using the password reset link will unlock your account immediately once you set a new password.

Why we do this: Account lockouts are a standard security practice to protect your account from credential stuffing attacks, brute-force password guessing, and unauthorized access attempts. This protects both your account and our platform.

6. User Conduct

You agree NOT to:

• Post false, misleading, or fraudulent reviews or ratings
• Spam, harass, or abuse other users or server owners
• Submit malicious, illegal, or inappropriate content
• Attempt to manipulate ratings, reviews, or rankings
• Use automated tools (bots, scrapers) without permission
• Interfere with, disrupt, or harm the Service or its infrastructure
• Circumvent security measures or access restrictions
• Impersonate others or misrepresent your affiliation
• Violate Discord's Terms of Service or Community Guidelines
• Submit servers/bots you don't own or have permission to list
• Post content that infringes copyright, trademark, or other IP rights

7. User-Generated Content

7.1 Content You Submit

When you post reviews, ratings, server descriptions, or other content ("User Content"), you:

• Retain ownership of your content
• Grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content on the Service
• Represent that you have the right to post the content and it doesn't infringe third-party rights
• Understand that your content will be publicly visible
• Can edit or delete your content at any time (subject to moderation retention)

7.2 Content Moderation

We reserve the right to moderate, remove, or refuse any User Content that:

• Violates these Terms or our Community Guidelines
• Is illegal, harmful, or inappropriate
• Infringes intellectual property rights
• Is spam, fake, or manipulative
• We determine is not in the best interest of the platform

We aim to review reported content within 48-72 hours.

Soft deletion system: When content is removed by moderation, we use "soft deletion" which means:

• Content is hidden from public view but retained in our database for moderation purposes
• Deletion reason is logged along with which admin performed the action and when
• 90-day appeal period: You can appeal moderation decisions within 90 days by contacting us through our contact form
• After 90 days: Soft-deleted content may be available for complete removal upon request (see our Privacy Policy for data deletion rights)
• Prevents abuse: Soft deletion prevents bad actors from deleting evidence of violations and maintains referential integrity (e.g., reviews stay linked to servers)

Appeals: If you believe content was removed in error, contact us via our contact form with subject "Content Moderation Appeal" within 90 days. Include the content details and explanation. Appeals are reviewed within 5 business days.

User-initiated deletion: If you delete your own content (reviews, ratings, etc.), it's also soft-deleted and hidden from public view. EU/CA users have the right to request complete hard deletion under GDPR/CCPA (see our Privacy Policy).

7.3 Section 230 Safe Harbor

Discovrd is a platform for user-generated content. Under Section 230 of the Communications Decency Act (U.S. law), we are not liable for content posted by users. We act in good faith to moderate harmful content but are not responsible for user posts, server descriptions, or third-party Discord content.

8. Content Rating System

Discovrd uses a content rating system to help users find age-appropriate communities:

• EVERYONE: Suitable for all ages, family-friendly content
• TEEN: May contain mild language, mature themes suitable for ages 13+
• MATURE: May contain strong language, mature discussions, ages 16+
• ADULT: NSFW content, explicit language, ages 18+ only

Content ratings are determined by server owners during submission and verified by our moderation team. ADULT-rated servers may require age verification. We rely on accurate self-reporting but cannot guarantee the appropriateness of all server content.

9. Server and Bot Submissions

9.1 Submission Requirements

By submitting a server or bot, you represent and warrant that you:

• Own or have explicit permission to list the server/bot
• Provide accurate, truthful information
• Comply with Discord's Terms of Service
• Select appropriate categories and content rating
• Are not submitting duplicate listings

Submitting a server or bot without proper authorization may result in immediate removal and account suspension.

9.2 Curation and Approval

All submissions undergo manual review. We curate listings based on quality, activity, moderation, and community value. Approval is not guaranteed. We may reject submissions that don't meet our quality standards or violate guidelines.

9.3 Listing Maintenance

Approved listings may be removed if:

• The server/bot becomes inactive or inaccessible
• Content or management violates our guidelines
• The Discord server is deleted or banned
• The listing owner requests removal
• Information becomes outdated and isn't updated

10. Premium Listings

10.1 Premium Features

Premium listings receive enhanced visibility through:

• Featured placement in category pages
• Highlighted appearance in search results
• Special badges and visual indicators
• Priority in recommendation algorithms

10.2 Payment and Billing

Premium listings are sold as time-based "boosts" processed through Stripe. Boost periods include 7-day, 30-day, and 90-day options. By purchasing:

• You authorize Stripe to charge your payment method for the selected boost period
• Boosts do NOT auto-renew - they are one-time purchases for a specific time period
• Boosts activate immediately upon successful payment and expire after the selected duration
• Multiple boosts can be purchased and will stack (queue) - if you buy another boost while one is active, the new boost starts when the current one expires
• You can view your active boost status and expiration date in your account dashboard
• Prices are subject to change with 30 days notice for future purchases (existing active boosts are unaffected)

Boost expiration: When a boost expires, your listing returns to standard (non-premium) visibility. You can purchase a new boost at any time to regain premium placement.

10.3 No Guarantees

Premium placement does not guarantee:

• Increased members, traffic, or engagement
• Specific ranking or position
• Approval or maintenance of listing (must still meet guidelines)
• Protection from negative reviews or reports

10.4 Refund Policy

Boost purchases are generally non-refundable once activated. We may issue time-based partial refunds at our discretion in the following situations:

• Service downtime: If the Service experiences significant downtime (more than 24 consecutive hours) due to our fault, we may issue a partial refund or boost extension calculated based on the downtime duration
• Listing termination without cause: If we terminate your listing without violation of these Terms, you'll receive a prorated refund for unused boost time
• Accidental duplicate purchase: If you accidentally purchase multiple boosts in quick succession (within 5 minutes), contact us immediately for a refund of the duplicate
• Payment processing error: If you're charged multiple times for the same boost due to a technical error, we'll refund the duplicate charges

Refunds NOT available for:

• Change of mind after boost activation
• Listing removal due to guideline violations
• Poor performance or lack of results from boost
• Boosts already consumed (expired time cannot be refunded)
• Stacked/queued boosts that haven't activated yet (non-refundable once purchased)

How to request a refund: Contact us via our contact form within 7 days of the issue occurring. Include your transaction ID and detailed explanation. Refund requests are reviewed within 5 business days.

11. Intellectual Property

11.1 Our Content

The Service's design, software code, algorithms, and original content are owned by Deckhand Software and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without permission.

11.2 Discord and Third-Party Content

Server information, bot data, and Discord-related content are sourced from Discord's public APIs and user submissions. Discord retains all rights to their platform, branding, and data. Server/bot owners retain rights to their content.

11.3 DMCA and Copyright Policy

We respect intellectual property rights. If you believe content on Discovrd infringes your copyright:

• Contact us via our contact form with "DMCA Takedown" in the subject
• Provide: Description of copyrighted work, infringing content URL, your contact information, good faith statement, signature
• We will investigate and remove infringing content within 72 hours
• Repeat infringers will have accounts terminated

12. Disclaimers and Limitation of Liability

12.1 Service "As Is"

12.2 Third-Party Platforms

We have no control over Discord servers, bots, or Discord's platform. We are not responsible for:

• Server content, moderation, or management
• Bot functionality, reliability, or security
• Discord platform availability or changes
• Interactions between users and server/bot owners
• Malicious bots, scams, or harmful content

12.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DISCOVRD AND DECKHAND SOFTWARE SHALL NOT BE LIABLE FOR:

• Decisions made based on information from the Service
• Loss of data, revenue, or opportunities
• Indirect, incidental, consequential, or punitive damages
• Service interruptions, downtime, or data breaches
• User-generated content or third-party actions
• Discord platform issues or server problems

If we are found liable despite this limitation, our total liability shall not exceed $100 CAD or the amount you paid for premium services in the last 12 months (whichever is greater).

13. Indemnification

You agree to indemnify and hold harmless Discovrd and Deckhand Software from any claims, damages, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms or Community Guidelines
• Your infringement of any third-party rights
• Content you submit to the Service
• Your interactions with Discord servers or bots

14. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for:

• Violation of these Terms or Community Guidelines
• Fraudulent, abusive, or illegal activity
• Manipulation of ratings, reviews, or rankings
• Creating multiple accounts to evade restrictions
• Any reason at our sole discretion

Upon termination, your right to use the Service immediately ceases. Sections of these Terms that by their nature should survive (warranties, liability limitations, indemnification) will remain in effect.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved in the courts of Ontario, Canada. You consent to the exclusive jurisdiction of those courts.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.

17. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Notice, and Community Guidelines, constitute the entire agreement between you and Discovrd regarding the Service and supersede any prior agreements.
